§ 01 · Agreement and Scope
These Terms of Service (hereinafter designated as the "Terms") constitute a legally binding agreement governing access to and utilization of the virtual reality software application titled Baboon!, including its compiled software binaries, associated digital assets, multiplayer networking infrastructure, backend services, virtual items, progression systems, and designated official community channels (collectively referred to as the "Game").
This agreement is established between the individual accessing or utilizing the Game (hereinafter designated as the "User," "player," or "you") and Bananabyte Games (hereinafter designated as the "Developer," "we," "us," or "our").
By downloading, installing, launching, accessing, or otherwise utilizing the Game, you acknowledge that you have had the opportunity to review these Terms and the Baboon! Privacy Policy and agree to comply with their applicable provisions. If you do not agree to these Terms, you must discontinue use of the Game and uninstall the software from your device, subject to applicable law.
Where a parent or legal guardian is legally authorized to act on behalf of a minor, that individual is responsible for providing appropriate supervision and ensuring compliance with applicable legal obligations. Nothing in these Terms overrides any non-waivable rights or protections provided by applicable law.
§ 02 · Eligibility and Authorized Use
Baboon! is intended exclusively for individuals who are at least thirteen (13) years of age. Individuals under the age of thirteen (13) are prohibited from downloading, installing, accessing, or utilizing the Game.
The Developer reserves the right to investigate reasonably substantiated eligibility concerns and restrict or terminate access where an account is determined to violate the applicable minimum-age requirement, subject to applicable law and relevant platform requirements.
Users between thirteen (13) and seventeen (17) years of age should obtain appropriate parental or legal guardian supervision when accessing online services, communicating with other players, or interacting with official community channels.
Access to the Game does not confer any ownership interest in the underlying software, infrastructure, intellectual property, or associated digital assets. All access remains subject to the limitations, restrictions, and conditions established under these Terms.
§ 02.01 · Developer and Internal Access Exception
Notwithstanding the minimum-age requirement established in § 02, individuals expressly authorized by the Developer may access the Game for legitimate development, testing, maintenance, security, or administrative purposes, provided such access complies with applicable law, parental or legal guardian requirements, and third-party platform policies.
This exception does not extend to ordinary gameplay by unauthorized individuals under thirteen (13) years of age and does not override any age restrictions imposed by Meta or other third-party service providers.
§ 03 · Software License and Intellectual Property
§ 03.01 · Grant of License
The Game is licensed, not sold. Subject to your continued compliance with these Terms, the Developer grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and utilize the Game for non-commercial entertainment purposes on authorized compatible virtual reality hardware.
This license does not transfer ownership of the Game, its source code, its underlying intellectual property, or any associated proprietary materials to the User.
§ 03.02 · Ownership and Reserved Rights
Except for materials owned by third parties, all rights, title, and interests in the Game and its original components remain with the Developer or their respective rights holders. Such components may include source code, compiled binaries, software architecture, models, textures, animations, audio, music, interfaces, branding, documentation, and other associated creative or technical materials.
Certain components may incorporate third-party software, open-source components, tutorial-derived implementations, or assets licensed under separate terms. Those materials remain subject to their respective ownership rights and applicable licenses.
No provision of these Terms shall be interpreted as transferring ownership of third-party materials to the Developer or granting the User rights that the Developer does not possess.
§ 03.03 · Restrictions on Use
Except where expressly authorized by the Developer or permitted by non-waivable applicable law, you must not:
Reproduce, redistribute, sell, sublicense, or commercially exploit the Game or its proprietary components.
Modify, adapt, or create unauthorized derivative works from protected portions of the Game.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or internal implementation details.
Remove, conceal, or alter copyright notices, proprietary identifiers, or other ownership information.
Use the Game or its components to develop, distribute, or facilitate unauthorized competing software or services.
These restrictions apply only to the extent permitted by applicable law and do not override rights that cannot legally be restricted.
§ 03.04 · Third-Party Trademarks and Affiliations
Baboon! is an independently developed software project and does not imply sponsorship, endorsement, or affiliation with Meta Platforms, Microsoft, Unity Technologies, Photon, or other third-party organizations unless expressly stated otherwise.
All third-party trademarks, product names, and service identifiers remain the property of their respective owners.
§ 04 · Third-Party Services and Integrations
The Game incorporates or relies upon third-party platforms, software development tools, networking infrastructure, cloud services, and digital distribution systems to provide its intended functionality.
These integrations may include the Meta Horizon Store and associated platform services, the Unity Engine, Microsoft PlayFab, and Photon networking services.
Your utilization of these third-party services may be subject to their respective terms of service, licensing agreements, privacy policies, technical requirements, and enforcement procedures.
The Developer does not independently control the availability, operational continuity, security practices, privacy practices, infrastructure, or future compatibility of external services. Accordingly, the Developer cannot guarantee that any third-party integration will remain available, unchanged, or compatible with every future version of the Game.
Interruptions, modifications, discontinuations, or policy changes affecting third-party services may consequently affect gameplay, account functionality, multiplayer connectivity, or the availability of associated features.
§ 05 · Accounts, Usernames, and Identifiers
§ 05.01 · User Responsibility
You are responsible for activity conducted through your player identity and for maintaining reasonable security over your account, device, and authentication credentials.
You must not knowingly permit another individual to use your identity to circumvent restrictions, impersonate another player, evade disciplinary action, or engage in conduct prohibited under these Terms.
§ 05.02 · Username Requirements
Usernames, display names, clan tags, and other player-selected identifiers must comply with applicable law and these Terms.
Prohibited identifiers include those that impersonate another person, falsely imply staff authority or corporate affiliation, contain hateful or materially abusive content, infringe third-party rights, or disclose another individual's private information without authorization.
The Developer may modify, reset, flag, restrict, or prohibit identifiers that violate these requirements, where reasonably necessary to protect users, enforce community standards, or maintain the integrity of the Game.
§ 05.03 · Account Integrity
You must not manipulate account identifiers, authentication information, or associated technical records for the purpose of obtaining unauthorized access, avoiding enforcement, misleading other users, or interfering with the Game's security systems.
Account-related restrictions may be imposed where reasonably necessary to address suspected fraud, impersonation, unauthorized access, or other violations of these Terms.
§ 06 · Community Standards and Prohibited Conduct
Users must behave lawfully and respectfully while participating in gameplay, multiplayer sessions, voice communications, and designated official community spaces.
The following categories of conduct are prohibited.
§ 06.01 · Harassment and Discrimination
You must not engage in bullying, stalking, threats, targeted harassment, hate speech, racism, homophobia, transphobia, misogyny, religious intolerance, ableism, or other discriminatory conduct directed toward another individual or group.
§ 06.02 · Sexual Misconduct and Exploitation
You must not engage in sexual harassment, grooming, sexually explicit communications directed at unwilling participants, unsolicited sexual advances, or coercive conduct intended to obtain intimate images, information, or interactions from another individual.
§ 06.03 · Privacy Violations
You must not dox other users, disclose private information without authorization, solicit sensitive personal information for improper purposes, or exploit confidential communications to threaten, harass, intimidate, or otherwise harm another individual.
§ 06.04 · Disruptive Behavior
You must not repeatedly engage in conduct that materially interferes with other users' ability to participate in the Game. Examples include excessive screaming, audio spam, abusive soundboard usage, unwanted physical interactions, avatar interference, obstructing spawn points, or repeatedly following or bothering individuals who have asked you to stop.
§ 06.05 · Deception and Impersonation
You must not impersonate users or staff, falsely claim administrative authority, fabricate evidence or staff instructions, knowingly submit false reports, or deliberately spread false allegations for the purpose of manipulating moderation decisions or disrupting the community.
§ 06.06 · Coercion and Improper Staff Pressure
You must not manipulate, threaten, intimidate, bribe, guilt-trip, or repeatedly pressure users or staff members to obtain ranks, privileges, promotions, disciplinary reversals, or other desired outcomes.
Ban evasion, coordinated pressure campaigns, retaliatory conduct, and attempts to bypass established moderation or appeal procedures are also prohibited.
§ 06.07 · Unwanted Solicitation
You must not spam advertisements, coerce users into joining external communities or attending real-world meetings, or pressure individuals into disclosing personal information.
§ 06.08 · Dangerous or Unlawful Activity
You must not use the Game, its communication systems, or its community channels to promote, coordinate, facilitate, or materially assist harmful or unlawful activities.
§ 06.09 · Cheating and Exploitation
Cheating, hacking, unauthorized client modifications, memory manipulation, packet injection, modified clients, and tools designed to provide unfair gameplay advantages are prohibited.
Knowingly exploiting bugs, glitches, physics behavior, or environmental geometry for unfair gain is likewise prohibited.
Suspected critical security vulnerabilities should be reported privately to legal@baboon.quest rather than publicly disclosed or exploited.
§ 06.10 · Ban and Restriction Evasion
You must not evade mutes, suspensions, matchmaking restrictions, or bans through alternate accounts, spoofed identifiers, proxies, account sharing, or other circumvention techniques.
Attempts to avoid the practical effect of an enforcement decision may be treated as additional violations.
§ 06.11 · Continuing Disruptive Conduct
Persistent disruptive behavior that substantially interferes with another user's peaceful enjoyment of the Game is prohibited, particularly where the conduct continues after a reasonable request to stop.
Knowingly encouraging, assisting, organizing, or coordinating violations of these Terms may also constitute a violation.
§ 07 · Staff Responsibilities and Administrative Authority
Developers, administrators, moderators, community managers, and other authorized staff members must exercise their assigned authority responsibly, fairly, and in good faith.
Staff members must not abuse permissions, threaten users for personal benefit, solicit sensitive credentials, misuse confidential information, falsify moderation records, retaliate against complainants, accept improper bribes, exploit conflicts of interest, access unnecessary private information, or manipulate disciplinary decisions for personal reasons.
Staff members remain subject to the same applicable community standards imposed upon other users. Possession of a staff role does not grant immunity from enforcement or authorize conduct otherwise prohibited under these Terms.
The Developer may suspend, restrict, demote, or revoke staff permissions where reasonably warranted by misconduct, abuse of authority, conflicts of interest, failure to perform assigned responsibilities, or other legitimate administrative concerns.
No staff position, rank, promotion, privilege, or administrative appointment is guaranteed to be permanent.
§ 08 · Technological Protection Measures and Security
§ 08.01 · Purpose and Scope
Baboon! employs technological protection measures (hereinafter designated as "TPMs") and related security mechanisms to protect the Game's software, intellectual property, infrastructure, user accounts, personal information, multiplayer integrity, and operational security.
These measures are intended to deter or prevent unauthorized access, copying, modification, circumvention, cheating, fraud, exploitation, and other misuse of the Game or its associated services.
§ 08.02 · Authorized Protection Mechanisms
To the extent permitted by applicable law, the Developer may implement, maintain, modify, or replace technical safeguards, including but not limited to:
Client integrity verification, authentication, digital signatures, and software validation.
Anti-cheat detection, device identification, and detection of unauthorized modifications.
Server-side validation of player actions, statistics, progression, and account records.
Encryption, rate limiting, traffic filtering, and abuse-prevention mechanisms.
Security logging, telemetry, audit trails, and technical analysis of suspected violations.
Detection of unauthorized memory manipulation, code injection, modified clients, packet manipulation, and attempts to bypass security controls.
Information collected or processed in connection with these mechanisms is subject to the Baboon! Privacy Policy and applicable privacy laws.
§ 08.03 · Prohibition on Circumvention
Except where expressly permitted or required by non-waivable applicable law, you must not knowingly circumvent, disable, remove, impair, tamper with, or interfere with TPMs or other security mechanisms protecting the Game.
Prohibited activities include bypassing authentication or client verification, defeating anti-cheat systems, removing technical restrictions, manipulating security checks, and utilizing tools or modifications specifically designed to defeat protective measures.
You must not knowingly assist, encourage, distribute tools for, or coordinate another individual's unauthorized circumvention of these protections.
Nothing in this Section is intended to prohibit activities that applicable law expressly permits or protects.
§ 08.04 · Server and Infrastructure Security
You must not attack, probe, overload, compromise, or obtain unauthorized access to the Game's servers, databases, matchmaking systems, relay infrastructure, administrative interfaces, or associated backend services.
Prohibited activities include distributed denial-of-service attacks, malicious payload delivery, unauthorized access attempts, destructive database operations, and network manipulation intended to disrupt services, compromise security, or obtain unauthorized information.
§ 08.05 · Deployment and Enforcement
The Developer may modify, replace, strengthen, or deploy TPMs and related security measures at any time, including through software updates, automatic updates, configuration changes, or server-side modifications.
Where reasonably necessary and permitted by applicable law, such changes may be deployed without advance individual notice.
Attempts to defeat or interfere with these protections may result in warnings, feature restrictions, account restrictions, temporary suspension, or permanent termination of access, depending on the severity, repetition, and impact of the conduct.
§ 08.06 · Applicable Legal Framework
The implementation and use of TPMs remain subject to applicable Canadian federal and provincial laws, including the Copyright Act, the Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable, and British Columbia's Personal Information Protection Act (PIPA).
Nothing in these Terms purports to authorize conduct prohibited by law or to remove protections that cannot legally be waived.
§ 09 · Moderation, Investigations, and Enforcement
§ 09.01 · Available Enforcement Measures
The Developer and designated moderators may investigate suspected violations and impose reasonable disciplinary measures according to the severity, repetition, and impact of the conduct.
Available measures may include warnings, mutes, username resets, session removals, matchmaking suspensions, temporary bans, permanent bans, and other proportionate access restrictions.
§ 09.02 · Investigations and Evidence
The Developer may review available reports, technical records, moderation information, and other relevant evidence to determine whether a violation has occurred.
Information concerning investigations, reporting users, or internal moderation decisions may be withheld where disclosure could compromise privacy, user safety, security, or the integrity of an investigation, subject to applicable law.
§ 09.03 · Appeals and Reviews
Permanent bans and other significant disciplinary decisions may be submitted for review through an appeal process at the Developer's discretion, subject to applicable legal obligations.
Submission of an appeal does not guarantee reversal, reinstatement, or restoration of removed content, privileges, or progression.
§ 09.04 · Enforcement Integrity
The Developer may take additional action where a user attempts to evade restrictions, retaliate against reporting individuals, interfere with an investigation, or otherwise undermine legitimate enforcement activities.
All enforcement remains subject to applicable law and any mandatory procedural or consumer protections.
§ 10 · Virtual Items, Progression, and Updates
§ 10.01 · Nature of Virtual Content
Virtual items, cosmetics, badges, currencies, ranks, statistics, achievements, progression records, and similar digital content made available through the Game (collectively referred to as "Virtual Content") do not inherently represent ownership of physical property or possess real-world monetary value.
Unless expressly provided through an authorized arrangement, Virtual Content is not redeemable for cash, physical goods, or other real-world consideration.
§ 10.02 · Availability and Modification
To the extent permitted by applicable law, the Developer may modify, rebalance, reset, wipe, restrict, replace, revoke, remove, or discontinue Virtual Content, gameplay features, progression systems, and other digital functionality.
These changes may affect content previously owned, earned, unlocked, received, or accessed by a User. Possession or prior access to Virtual Content does not guarantee permanent availability or continued functionality.
Such changes may be implemented with or without advance notice or compensation where legally permissible.
§ 10.03 · Updates and Discontinuation
The Developer may release updates, require patches, change gameplay mechanics, modify technical requirements, replace existing features, or discontinue all or part of the Game.
The Developer does not guarantee that existing content, saved data, features, or functionality will remain available indefinitely.
Nothing in this Section excludes mandatory consumer rights or other protections that cannot legally be waived.
§ 11 · Service Availability and Warranty Disclaimer
§ 11.01 · Technical Requirements
Online functionality requires a compatible device, an internet connection, and access to the relevant third-party services and infrastructure.
The Developer does not guarantee uninterrupted service, low latency, universal device compatibility, error-free operation, preservation of saved data, or uninterrupted access to multiplayer functionality.
Service availability may be affected by maintenance, software defects, security incidents, network conditions, third-party outages, platform changes, or circumstances outside the Developer's reasonable control.
§ 11.02 · Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Game and associated services are provided on an "AS IS" and "AS AVAILABLE" basis.
Except for warranties and guarantees that cannot legally be excluded, the Developer disclaims express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.
The Developer does not warrant that all defects will be corrected, that every device will operate identically, or that the Game will remain compatible with all future hardware, operating systems, or third-party services.
§ 12 · Limitation of Liability
To the maximum extent permitted by applicable law, Bananabyte Games and its contributors, moderators, and licensors shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to access to, use of, or inability to use the Game.
Where legally excludable, this limitation includes losses involving data, profits, revenue, reputation, business opportunities, or other intangible interests.
To the extent permitted by applicable law, the limitation also encompasses losses or damages associated with hardware malfunction, data corruption, application crashes, virtual reality discomfort, motion sickness, physical accidents, or associated expenses arising from use of the Game.
Nothing in these Terms excludes, restricts, or limits liability to the extent that such exclusion, restriction, or limitation is prohibited by applicable law. Any mandatory statutory rights remain unaffected.
§ 13 · Indemnification
To the extent permitted by applicable law, you are responsible for claims, losses, liabilities, damages, and reasonable legal costs arising from your unlawful misuse of the Game, material violation of these Terms, prohibited submissions, or infringement of third-party rights.
This provision applies only to the extent that the relevant claim or loss is attributable to conduct for which you are legally responsible.
Nothing in this Section requires a User to indemnify another party where such an obligation is prohibited by applicable law.
§ 14 · Dispute Resolution and Governing Law
§ 14.01 · Informal Resolution
Before commencing formal proceedings, the parties should provide written notice describing the nature of the dispute and make a reasonable, good-faith attempt to resolve it informally.
Notices to the Developer should be submitted to legal@baboon.quest with sufficient information to identify and investigate the issue.
Where practicable and legally permissible, the parties will allow forty-five (45) calendar days for informal resolution, unless applicable law, an urgent circumstance, or the need for emergency relief requires otherwise.
§ 14.02 · Individual Proceedings
To the extent legally enforceable, disputes will be pursued individually rather than through class or representative proceedings, and jury-trial waivers will apply only where permitted by applicable law.
Nothing in this Section prevents either party from seeking appropriate emergency injunctive relief or overrides mandatory consumer protections, statutory rights, or other non-waivable legal remedies.
§ 14.03 · Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without displacing mandatory legal protections that apply to the User.
Subject to applicable law and mandatory jurisdictional requirements, proceedings relating to these Terms will be brought before the courts located in Nanaimo, British Columbia, Canada.
§ 15 · Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the minimum extent necessary to address the relevant defect.
The remaining provisions will continue in effect to the extent they remain valid and enforceable under applicable law.
§ 16 · Termination and Amendments
§ 16.01 · Termination by the User
You may discontinue your use of the Game at any time by uninstalling the software and deleting associated local data where appropriate.
Uninstalling the Game does not necessarily delete account records, backend progression, moderation history, or information maintained by third-party service providers. Such records are handled in accordance with the Baboon! Privacy Policy and the applicable policies of those providers.
§ 16.02 · Termination by the Developer
The Developer may restrict, suspend, or terminate access to the Game for violations of these Terms, security concerns, misuse of the service, or other legitimate operational reasons, subject to applicable law.
Termination may affect access to Virtual Content, progression, multiplayer functionality, and other associated features. No provision of this Section overrides mandatory legal obligations or rights.
§ 16.03 · Amendments to These Terms
The Developer may revise, amend, or replace these Terms to reflect software changes, security requirements, operational needs, legal developments, or third-party platform requirements.
Revisions will be documented by updating the "Last Updated" date appearing at the beginning of this document.
Where legally valid, continued use of the Game following publication of revised Terms may constitute acceptance of the updated provisions. Where affirmative notice or consent is legally required, the Developer will comply with those requirements.
If you do not agree to revised Terms, you must discontinue use of the Game.
§ 17 · Contact and Acknowledgment
For legal notices, inquiries concerning these Terms, or formal communications relating to alleged violations, contact the Developer at:
Email: legal@baboon.quest
For personal information access, correction, deletion, or other privacy-related requests, refer to the Baboon! Privacy Policy and contact privacy@baboon.quest.
